KOTA KINABALU – Warisan is moving forward with legal action to compel the Sabah assembly speaker to remove Hassan A. Gani Pg Amir from his Sebatik assemblyman seat.
The party’s secretary-general, Datuk Loretto Padua, said that Warisan lawyers had documents indicating Hassan agreed to resign in the event he leaves the party.
This, Padua said, was stated in a Hassan’s letter of allegiance to Warisan.
“In a letter dated September 10, 2020 to his lawyers, Hassan instructed them to date and submit his resignation letter to the speaker and head of state in the event that he, among others, declares himself an independent before or after being sworn in as assemblyman,” said Padua in a statement.
The lawyers executed the instruction following Hassan’s announcement to become an independent last Thursday and letter of resignation the following day, which was submitted to Speaker Datuk Kadzim Yahya yesterday.
Warisan had earlier released a video of Hassan taking his oath and pledging allegiance to the party in the name of God, saying he would remain with the party till the end of his term.
In the clip, which was recorded after he was named Warisan’s candidate for Sebatik in the state election last year, Hassan pledged to submit his resignation to the speaker and head of state should he breach his allegiance to Warisan.
“All Warisan candidates made the pledge of loyalty to the party voluntarily, with no element of coercion from the party.
“It was Hassan’s second opportunity contesting in the state election under the Warisan ticket, having lost to the Barisan Nasional candidate in 2018,” Padua said.
He said Warisan was saddened by the speaker’s decision not to accept Hassan’s resignation as assemblyman and is, therefore, seeking legal recourse immediately. – The Vibes, March 3, 2021
