KUALA LUMPUR – Fahmi Reza claimed trial to his second charge over the last seven days, this time over a caricature resembling beer cans and the PAS logo.
According to the charge sheet, he is accused of uploading the disputed artwork through his Facebook account on June 1, 2021 at 11.45am.
His post was later flagged by a social media user located in Sentul the next day around 9am.
Today’s charges are over a graphic resembling a beer advertisement with two beer cans held by two hands, one with the Carlsberg beer logo and the other sporting a design similar to PAS’ emblem.
The graphic is captioned: “Carlsberg untuk semua” (Carlsberg for all).
Fahmi’s charge today was framed under Section 233(3) of the Communications and Multimedia Act 1998 over the improper use of network facilities to create and spread content deemed offensive or indecent in nature with the intent to annoy, abuse, or harass a person.
The offence is punishable with a fine not exceeding RM50,000, or imprisonment not more than one year, or both if convicted, and an additional RM1,000 fine for every day the offence continues to be committed after conviction.
Malaysiakini reported that deputy public prosecutor Najihah Farhana Che Awang had submitted to judge M. Edwin Paramjothy during the proceedings that bail should be set at RM10,000.
Fahmi’s lawyer Rajsurian Pillai then requested for lower bail, arguing his client has been obedient and punctual whenever required by authorities, and that he had just posted a RM5,000 bail last week over another caricature.
“The most important factor here is that he (Fahmi) is not a flight risk and would not disturb the prosecution witnesses or evidence,” he was quoted saying by the portal.
The judge then set bail at RM3,000 with one surety, with March 30 fixed as the next court date. – The Vibes, February 17, 2022
