KUALA LUMPUR – MySJ Sdn Bhd, the company at the centre of a controversy over the ownership status of the MySejahtera Covid-19 contact tracing app, will submit an appeal to the Court of Appeal in their bid to strike out a legal suit by a shareholder over alleged breaches to their shareholder agreement.

Earlier today, high court judge Datuk Ahmad Fairuz Zainol Abidin dismissed MySJ’s application to strike out the suit filed by shareholder P2 Asset Management Sdn Bhd and ordered for the suit to proceed with an amended statement of claim by the plaintiff.

“MySJ has instructed us to appeal to the Court of Appeal,” MySJ counsel Razlan Hari Zulkifli told The Vibes briefly when contacted.

In his judgement, Fairuz dismissed MySJ’s application to dismiss the suit filed by P2, on grounds that arguments in the suit must first be ventilated in and evaluated by the court before it can decide on whether or not to strike out a case.

The judge also ruled that P2 can submit an amended statement of claim, which will insert paragraphs accusing MySJ and fellow shareholders Entomo Malaysia and Revolusi Asia of breaching their share sales agreement.

The three entities had previously argued that P2 had failed to satisfy the legal requirements needed to amend their statement of claim.

P2, which holds a 7% stake in MySJ, is accusing Entomo Malaysia of inducing Revolusi Asia to breach their share sales agreements, and MySJ of inducing both Entomo Malaysia and Revolusi Asia to breach their agreement with P2.

P2 is also accusing Revolusi Asia of wrongfully attempting to terminate their share sales agreement of MySJ shares based on claims P2 had failed in their contractual duties.

Revolusi Asia allegedly entered a separate agreement with Entomo Malaysia and acted as their agents despite previously buying over all rights and properties of the MySejahtera platform from them, P2 said in its suit.

MySJ faces a separate civil suit filed by another shareholder, Hasrat Budi Sdn Bhd, similarly related to a dispute over their shareholder agreement. – The Vibes, April 15, 2022
