PETALING JAYA - A 50-year-old man was discharged and acquitted (DAA) by the Seremban Sessions Court for allegedly raping a four-year-old girl in a room between March 21 and 22, 2019.

Mohd Zairil Mohd Zin was also discharged and acquitted for a second charge of allegedly forcing the same girl to perform oral sex on him during the same period.

The offence allegedly took place in a room at a house in Taman Bukit Kempas, in Titi, Jelebu.

He was charged under Sections 376 (2) and 377 of the Penal Code.

A total of 14 witnesses were called to give statements during the trial before Judge Datin Surita Budin.

"After listening to statements from all the witnesses and considering the prosecution's case, the court finds that the prosecution has failed to prove a prima facie case against the accused," said the judge.

Deputy public prosecutor Goh Hsiao Tung prosecuted, while the accused was represented by Haresh Mahadevan and Ramzani Idris. - The Vibes, October 23, 2023
