A THREE-member panel reviewing allegations of sexual misconduct against International Criminal Court prosecutor Karim Khan unanimously found that a UN investigation did not establish misconduct or a breach of duty, according to a confidential report.
Middle East Eye reported that the panel submitted its findings to the Bureau of the Assembly of States Parties on March 9.
The report has not been made public. MEE said most of the ICC’s 125 member states had not seen it.
The report was seen by two diplomatic sources cited by MEE, while two others were familiar with its contents.
The panel was appointed to review findings by the UN Office of Internal Oversight Services (OIOS), which investigated allegations made against Khan.
According to the sources, the panel concluded unanimously that the factual findings by OIOS did not establish misconduct or a breach of duty under the relevant legal framework.
Khan has denied the allegations.
The OIOS investigation was launched in November 2024 after a member of Khan’s office made allegations of sexual misconduct against him. A second woman later came forward with allegations.
Khan subsequently took voluntary leave from his position while the investigation was ongoing.
The panel’s reported finding does not amount to a public ICC ruling clearing Khan, as its report remains confidential and was submitted to the ASP Bureau for consideration.
The allegations have drawn scrutiny because of Khan’s position as the ICC’s chief prosecutor and the court’s high-profile cases involving alleged international crimes.
The allegations against Khan are separate from the cases being pursued by his office, including those arising from the war in Gaza. - September 27, 2026
