A COMPANY director and Chief Operating Officer pleaded not guilty at the Shah Alam Sessions Court for conspiring and dishonestly misappropriating RM2.6 million to make payments for a non-existent supply of oil (RBD oil).

The first accused, Tan Chin Yang, 56, who is the Chief Operating Officer of Sawit Raya Sdn Bhd, pleaded not guilty after three charges were read out in front of Judge Datuk Mohd Nasir Nordin.

The three charges were committed on June 1 and 3, 2022 at the United Overseas Bank (M) Bhd in Klang, Selangor.

Chin Yang was accused of dishonestly misappropriating a sum of RM2,681,001.96 belonging to the company (Sawit Raya) by making payments for non-existent oil supplies (RBD oil) to the company Able Perfect Sdn Bhd through documents, namely a Commercial Invoice in the name of Able Perfect.

He is charged under Section 403 of the Penal Code for all three offences.

The second accused, Ng Keng Hoe, 51, who is the Director of Able Perfect Sdn Bhd, also pleaded not guilty after three charges were read to him.

Keng Hoe was charged with conspiring with Chin Yang to dishonestly misappropriate RM2,681,001.96 belonging to Sawit Raya by making payments for non-existent RBD oil supplies.

The accused committed the offence on the same date and place as Chin Yang and was charged under Section 109 of the Penal Code read together with Section 403 of the same Code.

Mohd Nasir allowed bail of RM100,000 each for both accused with a guarantor and ordered them to report to the MACC office every month.
