THE Kuala Lumpur High Court today ordered the owner of a TikTok account to pay RM100,000 to Datin Seri Rosmah Mansor over a defamatory statement, claiming that the former Prime Minister's wife was involved in practicing black magic, two years ago.
Justice Ahmad Shahrir Mohd Salleh ruled that Rosmah had successfully established her entitlement to damages in her lawsuit against Ku Muhammad Hilmie Ku Din, with a global award of RM100,000 deemed just and proportionate.
The court ordered interest at a rate of 5% per annum on the judgment sum to be imposed from the date of judgment until full satisfaction of the award.
While reading the judgement, the judge said the plaintiff had successfully proven her eligibility to receive damages for defamation.
“Having considered all the above considerations, this court is of the opinion that the total sum of RM100,000 is a fair and balanced assessment.
“The total sum of RM100,000 comprises general damages and aggravated damages.
“The claim for exemplary damages is not allowed as there is no strong evidence presented before this court to support the award,” he said.
On 19 September 2023, Rosmah filed a suit through Messrs Hafarizam Wan and Aisha Mubarak and demanded RM1 million in damages from Ku Muhammad Hilmie regarding the defamatory statements in question.
Through a supporting affidavit, Rosmah as the plaintiff named Ku Muhammad Hilmie as the defendant, after the man, who had 1,584 followers, uploaded a video recording to a TikTok account using the name 'CEO Heelmie Fighter' containing untrue statements on 22 March of the same year.
Rosmah said the amount of damages was appropriate considering the defamatory statement had destroyed her credibility, good name and reputation.
She requested that the damages take into account her status, background, achievements, as well as considering that her reputation as a well-known figure and patron of several charities in the country had been tarnished.
On May 28 last year, Rosmah obtained a default judgment against the defendant, at the High Court. - July 8, 2025
