Najib, who began serving his sentence in August 2022 for misappropriating RM42 million from SRC International, had his 12-year sentence halved following a royal pardon in 2022.

Federal court dismisses Najib's appeal over alleged royal order

THE Federal Court in Putrajaya dismissed Datuk Seri Najib Razak's preliminary objection to the government's request to appeal his challenge over the alleged royal order.

The panel, chaired by Chief Judge of Malaya Justice Hasnah Mohammed Hashim unanimously dismissed Najib's preliminary objection after hearing submissions from parties.

Other members of the bench were Federal Court judges Datuk Zabariah Mohd Yusof and Datuk Hanipah Farikullah.

The panel will proceed to hear the application for leave to appeal where the AG will argue on why the matter should be allowed to be heard on its full merits at the apex court.

Senior lawyer Tan Sri Muhammad Shafee Abdullah appeared for the former prime minister.

The former prime minister filed the application for leave for judicial review on April 1, 2024.

On July 4, 2024, the Kuala Lumpur High Court dismissed Najib's application for leave, citing hearsay in supporting affidavits. He later won his appeal at the Court of Appeal.

Najib claims that a royal addendum allows him to serve the remainder of his jail term under house arrest.

The 71-year-old is seeking a mandamus order compelling the respondents to confirm and disclose the existence of the alleged additional document dated Jan 29, 2024. – March 24, 2025
