THE Shah Alam High Court today allowed an inquest to be held on the death of a Universiti Teknologi Mara (UiTM) Shah Alam Reserve Officers Training Unit (Palapes) Muhammad Amir Rusyaidi Muhamad Zaidi, in November last year.
Judge Roszianayati Ahmad, however, rejected the application to exhume the grave of the deceased Muhammad Amir Rusyaidi who was buried at the Taman Firdaus Cemetery in Kampung Sungai Lang in Banting, Kuala Langat.
The decision was made after examining the notice of motion and affidavit filed as well as the submissions of the parties involved.
The judge also ordered the police to reopen the investigation to find out the cause of death.
In the proceedings, Roszianayati said there was no discrepancy regarding the cause of death of the deceased so that his body needed to be exhumed and a second autopsy performed.
She said the cause of death of the deceased had been identified through examination and treatment carried out by the medical team at the Shah Alam Hospital, namely heat stroke which led to the failure of various organs.
“It is undisputed that the deceased was taken to the hospital at 5pm, 10 November 2024 and died after three days of receiving treatment. During the treatment period, various examinations and clinical tests were conducted which showed that the deceased was severely dehydrated to the point of involving other internal organs.
“The doctor also said that no other physical injuries were found except for a red mark on the knee which did not lead to the death of the deceased.
“Witnesses involving friends and coaches also confirmed that they underwent aggressive training the day before the incident,” she said.
The deceased’s father, Muhamad Zaidi Abdul Rahman as the applicant was represented by lawyers Nur’Aminahtul Mardiah Md Nor, Nur Izzati Hafieza Ismail and Putri Ainaa Amiera Megat Mustaffa Albakri.
Meanwhile, the first respondent, the Ministry of Home Affairs (KDN) was represented by Nurul Huda Mohd Salehuddin and Nur Syahidah Mohamad Kamil, while the second respondent, the AGC, was represented by the Selangor Director of Public Prosecutions, Datin Kalmizah Salleh.
It was reported that the court had set November 20 for the hearing of the decision on the application to exhume the grave of the late Muhammad Amir Rusyaidi.
The date was set after the KDN and AGC, as respondents, requested time to file an affidavit in response to the application made by Muhamad Zaidi.
In the incident on 10 November 2024, the UiTM student was said to have fainted while participating in a training session at the parade ground before being taken to hospital for treatment and reportedly died three days later.
His family members, through a press conference, hoped that a transparent and comprehensive investigation would be carried out by the police to demand justice for the eldest of four siblings. - November 20, 2025
