THE Ministry of Finance was told to process applications recommended by the Prime Minister’s Office for projects under the Jana Wibawa programme, the High Court heard today.
Datin Rosni Mohd Yusoff, who was then secretary of MOF’s Government Investment Companies Division, said the instruction came from Treasury deputy secretary-general (Policy) Datuk Zamzuri Abdul Aziz.
Rosni, 54, is the 25th prosecution witness in the trial of Bersatu president Tan Sri Muhyiddin Yassin.
Muhyiddin is facing four charges of using his position to obtain RM225.3 million in bribes and three money laundering charges involving RM200 million.
Rosni said the Procurement Division only processed Jana Wibawa applications sent through the PMO.
“The PMO would send the applications to the MOF office, and they would then be minuted to the Procurement Division for further action.
“From there, the Procurement Division would assess the companies before bringing them to the Jana Wibawa Contractor Evaluation Committee,” she said.
She was answering questions from Deputy Public Prosecutor Nuralis Mat.
Rosni said there was no interference when the committee made its decision.
However, she said the instruction for the companies to be assessed came from the PMO through the MOF office.
Nuralis then asked her about the difference between communication, a minute and an instruction, after the defence raised the issue.
Rosni said the minute in an official document reflected the action to be taken by the MOF office.
That was followed by instructions to Zamzuri and herself, she said.
“The process started from the PMO to the MOF office, and then the instruction was given to the secretary of the Procurement Division to carry out the action stated in the minute,” she said.
She added that the instruction was the authority for her to act.
Asked whether the instruction would come without any prior communication, Rosni said: “Yes, correct.”
Earlier, Rosni told the court that the Jana Wibawa Contractor Evaluation Committee would not have assessed KCJ Engineering Sdn Bhd and Nepturis Sdn Bhd if their names had not appeared in letters from the prime minister dated November 13, 2020 and February 3, 2021.
Without the committee’s assessment, she said, the companies would not have been eligible for the pre-qualification tender process by the Public Works Department.
She said the assessment was a mandatory requirement for contractor appointments under the Jana Wibawa programme.
Rosni said Sutracom Sdn Bhd also had to submit a letter of interest through the PMO before it was sent to MOF for assessment.
She told the court that the names of contractors and projects proposed under Jana Wibawa came from the PMO.
Muhyiddin, who is also Pagoh MP, is accused in the first four amended charges of using his position as prime minister and Bersatu president to obtain RM225.3 million in bribes.
The money was allegedly received from businessman Datuk Azman Yusoff, 51, and four companies — Bukhary Equity Sdn Bhd, Nepturis Sdn Bhd, Mamfor Sdn Bhd and KCJ Engineering Sdn Bhd — for the benefit of Bersatu.
The fifth to seventh charges accuse Muhyiddin of receiving proceeds from unlawful activities amounting to RM200 million, including money from Bukhary Equity that was deposited into Bersatu’s CIMB Bank account.
