Contractor claims trial to charge of using fake ‘Datuk’ title on card

KUALA LUMPUR – A contractor pleaded not guilty at the Ampang Magistrates’ Court here today to a charge of handing over his business card with the title “datuk” that was not recognised to a woman four years ago. 

Mohamed Rafi Mohamed Hanifa, 37, allegedly handed the woman a business card with the name Datuk Mohamed Rafi Mohamed Hanifa displaying the national coat of arms.

He was charged with committing the offence at a law firm in Ampang Jaya, at about 10am on October 5, 2019, in accordance with Section 3 (1)(a) of the Emblems and Names (Prevention of Improper Use) Act 1963 which is punishable under Section 5 of the same act. 

The section provides a fine not exceeding RM20,000 or a maximum imprisonment of three years or both, if convicted. 

Deputy public prosecutor Annur Athirah Amran offered bail of RM7,000 with one surety,  while lawyer Uma Gunaseelan,  representing the accused asked for lower bail on the grounds that her client was the sole family breadwinner and had no risk of fleeing. 

Magistrate Amalina Basirah Md Top allowed Mohamed Rafi bail of RM5,500 with one surety and fixed May 24 for mention.
